By downloading, installing, or using the GoVitals mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and AVIFA INFOTECH PVT LTD ("Company," "we," "us," or "our") regarding your use of the App.

GoVitals is a smart health logging and tracking application designed to help users track blood sugar, blood pressure, weight, SpO2, scan reports with an AI camera, and share secure links with doctors. The App provides interval tracking, real-time logging, and health report capabilities to help users maintain a clear record of their vitals.

The App is provided "as is" and "as available" without any warranties of any kind.

You must be at least 13 years old to use the App. If you are under 18, you must have parental or guardian consent to use the App.

You represent and warrant that you have the legal capacity to enter into these Terms and to use the App in accordance with these Terms.

Our total liability to you for any claims arising from your use of the App shall not exceed the amount you paid for the App, if any, or $10, whichever is greater.

You agree to indemnify, defend, and hold harmless AVIFA INFOTECH PVT LTD and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the App or your violation of these Terms.

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the App will cease immediately. If you wish to terminate your account, you may simply discontinue using the App.

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts in Kolkata, West Bengal, India.

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect.

What constitutes a material change will be determined at our sole discretion. By continuing to access or use our App after any revisions become effective, you agree to be bound by the revised terms.

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

These Terms constitute the entire agreement between you and AVIFA INFOTECH PVT LTD regarding the use of the App, superseding any prior agreements between you and us relating to your use of the App.
